Lawmakers in conference have just inserted new language that would devastate Virginia’s h**p industry by striking the 25:1 ratio and limiting THC to 2mg per package. If this passes, it would effectively wipe out most compliant h**p products and force thousands of Virginia small businesses to close.

The h**p-related provisions added in conference go far beyond what had previously been considered and create serious harm for existing lawful h**p businesses across the Commonwealth. These changes were not part of the earlier legislative debate, yet they could effectively eliminate a workable path forward for compliant operators who have invested capital, hired employees, signed leases, and built businesses in reliance on current Virginia law.
Striking the 25:1 allowance from the definition of h**p would eliminate nearly 95% of the existing market, shutter thousands of small businesses, and disrupt access to affordable h**p products that Virginians rely on—such as low-dose THC beverages, gummies, and tinctures used for relaxation, sleep, and stress support.
Consumers include working professionals seeking alternatives to alcohol, veterans and seniors looking for gentler wellness options, and adults in rural areas without access to dispensaries who rely on h**p retailers as their only affordable legal option.
By eliminating the 25:1 ratio and imposing a 2mg per package limit, the conference report would not meaningfully regulate the market—it would effectively prohibit it, forcing widespread closures of independent Virginia businesses and pushing consumers toward more expensive or unregulated markets.
Our concern is not with reasonable regulation or consumer protection. It is with sweeping restrictions being inserted late in the process without adequate vetting, stakeholder input, or a fair transition for existing businesses.
For many Virginia small businesses, these are not minor technical changes—they are existential.
