ANOTHER GOOF BALL. This man has great taste in scotch but he’s BROKE! CLOWN! Hahahaha.

Anyways, OG here pulled up to our second location with his big goofy shoes and his dirty tank top and decided he was gonna pull $350 worth of scotch off our shelves and not pay for it.

If you’re broke just say that!

Then proceeds to get into the jankiest Nissan SUV to ever touch the lot. That thing was thumping but it was the loose timing belt.

Request for Qualification for Architectural, Planning, Design and Related Services in Connection with the Construction
of a Replacement/New ABC Store
(419 N. Main St., Lexington, NC 27292)

Purpose of RFQ
The Lexington Board of Alcoholic Control, North Carolina, invites qualified firms to submit a qualification proposal (Proposal) in accordance with North Carolina General Statutes to provide professional architectural design and construction services (Services) associated with the planning, design, plan review, and related activities for the construction by the Board of a new store to replace the present Lexington ABC Store located at 419 North Main Street, Lexington, North Carolina 27292.

Scope of Services
The scope of services will include, but not necessarily be limited to, the following:

• Preparation of design, demolition, and construction plans and specifications for the construction of a NEW ABC Store located at 419 North Main Street, Lexington North Carolina 27292 (“the Project”).

• Fully engineered design for construction of approximately 9,000 square-foot facility, to consist of new retail space, office and storage areas, addition of cold drink storage, cellar room, and a warehouse/receiving room. The design shall comply with applicable regulations for accessibility in design of the Project and provide for adequate security of the Project and compliance with all laws, rules, and regulations governing the construction of the Project including any ABC-specific requirements.

• Fully engineered design for parking area expansion.

• Provision of bidding and construction administration services, including, but not necessarily limited to, systems and processes to ensure the construction work meets all specified standards and is free from defects, provision of experienced project managers to oversee the Project from start to finish and to ensure that the Project stays on schedule and within budget, and other appropriate construction management and quality control measures.

• Consultation and/or preparation of permit applications related to the facility construction.

• Preparation of cost estimates.

• Regular updates and clear communication channels between the Lexington Alcoholic Control Board and its administration and the construction team to promptly address any issues as they might occur.

Contents for Proposals
The Proposal shall be submitted as a single electronic document. A table of contents with corresponding page numbers shall be included for easy reference to the material contained within. Submittals shall include no more than 10 pages total, not including the table of contents. Firms are not required to submit bound hard copies of the proposal, however if a firm chooses to provide hard copy, only one (1) shall be provided. The submission of any hard copy shall not negate or be deemed sufficient to satisfy the requirement of an electronic submission. The following information must be included in the Proposal.

A. Introductory Letter: Include a letter from a firm principal stating the firm’s full name, contact information (i.e. phone, e-mail, facsimile number, etc.), primary contact person for the firm and his/her contact information, brief history of the firm, a general statement of interest in providing the Services to the Board and any other information which may be relevant about the firm and its qualifications.

B. Project Team(s): Provide an organizational chart specifying architects, project managers, key personnel, subcontractors and statements of responsibilities and roles. Include brief resumes and a list of certifications, professional affiliations and licenses of key personnel who will provide Services. Any listing of licenses shall include the name of the board or agency issuing the license, the license number, the date of original issuance, and the status of the license (e.g. current, expired, suspended, or revoked). If the license of such key personnel is suspended or revoked, the firm shall provide a statement of the grounds given for the suspension or revocation of the license.

C. Understanding of Scope of Work Statement: Firms should include a general outline of the specific methodologies and approaches to fulfilling the general scope of work. Indicate any work or resources that are to be subcontracted or assumed to be provided by the Board. Include your firm’s approach to quality assurance or quality control.

D. Qualifications: Demonstrate general qualifications and areas of expertise by providing a list of certifications of the firm and its key personnel and brief examples of projects or work related to the scope of services listed herein, with particular emphasis on projects located in North Carolina. The examples herein may include those of prior completed work, but no work product or design may be submitted or considered as part of the selection process. Provide a minimum of three (3) references with knowledge of projects matching the scope of this RFQ. References should include primary contact person, name of project, a brief description of the project, initial schedule versus actual (or as-built) schedule and any difficulties or successes experienced.

E. Project Schedules: Provide a project schedule and what methods your firm uses to ensure the schedule is met. If a contract is awarded, the selected firm must be able to begin work immediately and move promptly toward completing the Services. Describe the firm’s capacity to complete the services in a timely manner and note current workload, backlog, and anticipated work during the period of one-year beginning from the date of the submission of the firm’s statement of qualifications in response to this Request for Qualifications.

F. Standard Fee Schedule: Include a list of hourly billing rates by position such as Principals, Architects, Construction Administrators, Designers, Contract Administrator, Project Manager, Licensed Surveyor, Survey Technician, Survey Crew, CAD Operator, Planner, Clerical, Intern, etc., including sub-consultants. Also, include a schedule of eligible reimbursable expenses, such as: mileage, printing costs, courier, etc.

G. Current Certificates of Insurance: A current Certificate of Commercial Liability Insurance, current Certificate of Professional Liability Insurance, and current certificates of automobile liability and workers’ compensation insurance. The certificates shall set forth the coverages and limits of coverages for the firm. The insurance requirements are set forth more fully in this Request for Qualifications.

H. Why your firm? Provide any additional information to explain why your firm is best suited to provide Services to the Lexington Board of Alcoholic Control.

Method of Evaluation
The criteria used to evaluate the Proposals will include, but not be limited to, the following (items are not listed in order of importance):
A. Firm Experience/Reputation/Workload: Experience of the firm in similar work and record of successful results of that work. Also considered will be the firm’s ability to take on additional work, demonstrated understanding of the Board’s goals and purposes of the project, specific management approach, how well the firm’s organizational structure shows sufficient depth of its present workload, and the firm’s ability to offer the breadth and quality of services required for the Board’s project. Additionally, the firm’s successful experience performing other services for the Board on past and current projects may be considered.

B. Experience of the Personnel Assigned to This Project Team: The Board will give considerable weight to the individual qualifications of the project team members who will do most of the work on the project. Consideration will include qualifications of key personnel, project team member’s individual experience and other qualifications, project manager’s experience and sub-consultant’s (if applicable) individual experience and qualifications.

C. Understanding of the Statement of Work: The ability of the firm to outline a realistic approach to municipal project planning, design and management will be considered; as will the proposed approach for performing the Services, including demonstrated understanding of the scope of work and potential problems associated with this type of work. A comprehensive understanding of local conditions related to municipal projects and development of engineering documents will be considered.

D. Schedule: Available resources to complete project, including the analytical, design tools, personnel, resources or methodologies commonly used by the firm that may be applicable will be considered. Consideration will be given to the firm’s availability to complete the project within a reasonable and desired timeframe.

E. Work Performed Locally: The firm’s location and ability to perform the work locally will be considered.

F. Response: Responsiveness to the RFQ, including any additional documents submitted will be considered.

Additional Instructions, Notifications, and Information
No Gratuities – Respondents to this Request for Qualifications shall not offer nor solicit, instruct, or otherwise cause anyone to offer any gratuities, favors, or anything of monetary value to any member, official, employee, or agent of the Board for the purpose of influencing any selection of a Respondent, any rejection of a Respondent, or otherwise a decision in connection with this Request for Qualifications or response to it. Any attempt by a Respondent to influence the selection process by any means, other than disclosure of qualifications and credentials through the proper channels, will be grounds for exclusion from the selection process and consideration for this Project.
Conflict of Interest -- In addition to the prohibition against self-benefiting from a public contract under N.C.G.S. Section 14-234, no officer, employee, member, or agent of the Lexington Board of Alcoholic Control may participate directly or indirectly in the selection, award, or administration of a contract supported by a federal or State award if such person has a real or perceived contract of interest. A real or perceived conflict exists when any of the following parties has a financial or other interest in or receives a tangible personal benefit from award of a contract: the officer, employee, elected official, governing body member, or agent involved in the selection, award or administration of a contract; any member of the immediate family of any of these persons or the partner of any such persons; shareholder or an organization (or shareholder, director, officer, member, manager, supervisor, venture or partner of such organization) which employees or imminently intends to employ any of these persons or parties. Any such conflict shall be disclosed in writing and included with the Proposal. Contractors which are related to personnel of the Lexington Board of Alcoholic Control having any influence over decisions to consider or award a contract are strictly prohibited from bidding, responding to, or accepting an award of Lexington Board of Alcoholic Control contracts. Accepting gifts and favors from vendors and contractors is prohibited under North Carolina General Statutes Section 133-32. In addition, officers, employees, elected officials, governing body members, and agents of Lexington Board of Alcoholic Control are prohibited from accepting or soliciting gifts, gratuities, favors, or anything of monetary value from contractors, suppliers, or parties to subcontracts. Violation of this policy will result in disciplinary action for the employee and termination of the contract, and the firms and persons in violation may not be eligible for future contract awards.
All Information True – By submitting a response, Respondents represent and warrant to the City that all information provided in the response submitted shall be true, correct, and complete. Respondents who provide false, misleading, or incomplete information, whether intentional or not, in any of the documents presented to the Lexington Board of Alcoholic Control for consideration in the selection process may be excluded from consideration or from participation in the Project.
Interviews – After the initial evaluation of the statements of qualifications, Respondents will be notified of their status in the selection process. If interviews are initiated, they will most likely focus not only on the Respondent’s program approach but also on an appraisal of the design professionals who would be directly involved in the project.
Inquiries – Do not contact the Board (or its members, agents, employees, attorneys, officers) or any employee, agent, officer, council member, or the Mayor of the City of Lexington, North Carolina to make inquiries about the progress of the selection process. Cost of Responses – The Board will not be responsible for the costs incurred by anyone in the submittal of responses.

The Lexington Board of Alcoholic Control prohibits discrimination against any person or business in pursuit of opportunities in any aspect of the Board’s contracting and procurement programs, including, but not limited to employment, construction development projects, and materials or services based upon s*x (including pregnancy, gender, s*xual orientation, gender identity, or gender expression), race, color, religion, national origin, age, disability, genetic information, veteran status, or any other legally protected characteristic and other laws concerning the awarding of public contracts. It is the policy of the Board to comply with all applicable nondiscrimination laws. It is further the Board’s policy to conduct contracting and procurement so as to prevent such discrimination and to resolve any and all claims of such discrimination. If there is any conflict between the provisions of this Request for Qualifications and antidiscrimination laws or laws concerning the awarding of public contracts, then the provisions of such antidiscrimination laws or laws concerning the awarding of public contracts shall control.
Contract Negotiations; Contract – This Request for Qualifications is not to be construed as a contract, offer, or as a commitment of any kind. If this RFQ results in a contract offer by the Board, the specific scope of work, associated fees, and other contractual matters or the rights and obligations of the Board and any party awarded a contract will be determined during contract negotiations and will be governed by any such contract entered into by the Board shall control.
No Obligation – The Board, in its sole discretion, reserves the right to: (1) evaluate the responses submitted; (2) waive any irregularities therein; (3) select candidates for the submittal of more detailed or alternate proposals; (4) accept any submittal or portion of submittal; (5) reject any or all Respondents submitting responses should it be deemed in the Board’s best interest; or (6) cancel the entire process.
Insurances – The firm shall provide a statement of the current insurances the firm carries to include, but not be limited to, worker’s compensation, commercial general liability, automobile liability and professional liability. Appropriate insurance shall be written by an insurer authorized to transact insurance in the State of North Carolina.
The chosen firm shall be responsible for obtaining and maintaining adequate liability insurance to fully protect the Lexington Board of Alcoholic Control. The chosen firm shall provide the following minimum limits of insurance coverage:

Worker’s Compensation: The Respondent shall maintain Worker’s Compensation insurance in accordance with Chapter 97 of the North Carolina General Statutes and limits of no less than $1 million per accident, per disease, per employee.

Commercial General Liability: Bodily injury and property damage liability as shall protect the contractor and any subcontractor performing work under any contract resulting from this RFQ from claims of bodily injury or property damage which arises from operation of said contract whether such operations are performed by contractor, any subcontractor, or anyone directly or indirectly employed by either. The amounts of such insurance shall not be less than $1,500,000 Each Occurrence, and $2,000,000 Aggregate. This insurance shall include coverage for products/completed operations, personal and advertising injury liability and contractual liability.
Automobile Liability: Limits of at least $1,500,000, on a combined single-limit basis. Coverage shall include liability for owned, non-owned, and hired automobiles. In the event the contractor or Respondent does not own automobiles, the Contractor/Respondent agrees to maintain coverage for hired and non-owned automobile liability insurance, which may be satisfied by way of an endorsement to the Commercial General Liability Policy or separate automobile policy. Automobile coverage is only necessary if vehicles are use or are to be used in the provision of services under any contract concerning this contract or are brought upon the Project site or other site or property of the Lexington Board of Alcoholic Control.
Umbrella: Respondent may satisfy the minimum liability limits required above under an umbrella or excess liability policy. There is no minimum per occurrence limit of liability under the umbrella or excess liability. However, the annual aggregate limits shall be no less than the “each occurrence” limit for the required policies, and it is the intent of this Request for Qualifications, and any contract entered into that the Respondent/Contractor have at least coverage in the amounts required for commercial general and automobile liability coverage. Respondent/contractor agrees to endorse or otherwise designate the Lexington Board of Alcoholic Control as an “Additional Insured” on the umbrella/excess liability coverage, unless the Certificate of Insurance states the umbrella or excess liability policy provides coverage on a “Follow-Form” basis.

Professional Liability: Insuring against professional negligence or errors and omissions on an occurrence or claims-made basis with policy limits of $2,000,000.00 per claim and $4,000,000 per annual aggregate. If insurance is provided on a claims-made basis, “tail” coverage will be required at the completion of any agreement arising from this RFQ for a duration of thirty-six (36) months, or the maximum time period reasonable available in the marketplace (whichever is less). The firm shall furnish certification of “tail” coverage as described or continuous “claims-made” liability coverage for thirty-six (36) months following completion of its services under any agreement arising from this RFQ. Continuous “claims made coverage will be acceptable in lieu of “tail” coverage provided its retroactive date is on or before the effective date any agreement arising from this RFQ. If continuous “claims made” coverage is used, the firm shall be required to keep the coverage in effect for duration of not less than thirty-six (36) months from the end of any agreement arising from this RFQ. This will be a condition of the final acceptance of work or services.

Cyber Insurance: Network risk and cyber liability coverage (including for unauthorized access, failure of security, breach of privacy perils, as well as notification costs and regulatory defense) in an amount of not less than $1,000,000. Such insurance shall be maintained in force at all times during the term of the agreement resulting from this RFQ and for a period of two (2) years thereafter for services completed during the term of the agreement.

The Lexington Board of Alcoholic Control shall be named and endorsed as an additional insured on the chosen firms Commercial General Liability, Auto Liability, Cyber insurance, and umbrella/excess coverage policies.

Proprietary Information: All Proposals are considered public record and available for public inspection as required by North Carolina General Statutes Section 132-1.2. Trade secrets or proprietary information submitted by a firm in connection with a procurement transaction shall not be subject to public disclosure under the North Carolina Public Records Act pursuant to North Carolina General Statutes Section 66-152(3). However, the firm must invoke the protection of this section prior to or upon submission of the data or other materials and must identify the data or other materials to be protected and state the reasons why protection is necessary. Each individual page considered a trade secret or proprietary information must be labeled “Confidential” in the top right corner of each such page. This right of privacy will be construed as narrowly as possible to protect the interests of the party responding to the RFQ while attempting to maximize the availability of information to the public.
Iran Divestment Act: Effective October 1, 2015, units of local government in North Carolina are prohibited from entering into certain contracts unless the contractor and the contractor’s subcontractors, if any, comply with the requirements of Article 6E, Chapter 147 of the North Carolina General Statutes, otherwise known as the “Iran Divestment Act.”
Divestment from Companies That Boycott Israel: The Respondent/Contractor shall certify that (a) it is not identified on the Israel Boycott List or any other list created by the North Carolina State Treasurer pursuant to North Carolina General Statutes Section 147-86.80 et. al., and (b) it will not take any action causing it to be placed on or appear on any such list during the term of any contract which may be awarded as a result of this Request for Qualifications.
