Hey everyone, it has been a long time since we have had a post like this, but right now, we at Smooth V**e, as well as everyone in the v**e industry, need your help.
The state of Pennsylvania is currently planning to roll out a new piece of legislation, which if passed, would entirely kill the v**e industry within the state. The only surviving products would be products such as Vuse and NJOY, notably products owned by cigarette companies, while all disposables, E-liquids, and refillable systems would become illegal to sell within the state. This is being done under the banner of "Protecting the youth," something which we at Smooth V**e find ironic considering how widely available the surviving brands would be, as they are mostly found in gas stations, not specialist v**e shops.
The bill in question is House Bill 1425, a bill lead by a slew of both Democrat and Republican representatives of the state. Through this bill (which if passed would take place 60 days later), all retailers would have 120 days to become compliant with the bill from the start date provided, meaning all retailers who sell v**e goods would have four months in order to sell all product, after which we would be forced to stop selling the products in which we have all become accustomed to. This is not limited to just one part of the industry either, all disposable brands (i.e. Geekbar, Raz, Oxbar, Fifty Bar, Foger, etc.) would be ineligible for sale per the new regulation. As would all juice brands (Juice Head, Cloud Nurdz, Innev**e, Monster Labs, etc.). In essence, if this bill were to pass, all v**e retailers in PA would have to pivot industries or become wholly smoke shops rather than v**e shops after four months.
As for how this bill eliminates these products, a link to the bill will be at the end of this post for those who wish to read it themselves, but the shortened answer has to do with the FDA and the PMTA process which was introduced in 2018. Seven years after introducing this piece of regulation to the industry, the FDA has only granted a "passing" status to roughly 45 devices/their associated pods, again mostly being Vuse or NJOY products, as well as similar devices owned by cigarette companies. Per Heading (b) Section (1) Subsection (i-ii), all companies who are either not fighting in court with the FDA (which many court battles do still continue to drag on, though some have fully lost their battles), or have not received a passing grade from the FDA (something which has become impossible as the FDA has stated they will not pass flavored products), must be taken off the market after the 120 days for compliancy is up. This would again mean the death of Juice Head, Cloud Nurdz, Monster Lab, and many other juice brands, as well as the death of disposables on the market.
We here at Smooth V**e have seen similar things on a federal level, but never at a state level. Luckily for us and all of our Smooth V**e family, you included, our state senators will be the next to vote on this bill. Included at the bottom of this post will also be a link to the PA state senators' email addresses. We urge everyone with the time and the energy to reach out and explain why this is a bad idea to our senators. Not only will they kill the industry in its entirety, but our industry is a major source of state tax revenue. All of that tax revenue will cease, the most widely available v**es for children such as Vuse and NJOY will still be available at gas stations for them to purchase, and the survivors in the industry will be bled dry even further through additional bonds and payments to the state that are included in this bill.
