🚫MYTH: If someone doesn’t pay their debt, you can sue them for estafa.
✅ FACT: Failure to pay a debt does not automatically amount to estafa. Estafa is a criminal offense that involves deceit, fraud or misrepresentation resulting in financial harm or damage to another person or entity. Simple non-payment is a civil matter, not a criminal one.
⁉️What to do: For unpaid debts, you can file a civil case for collection of sum of money or small claims if the amount does not exceed 1 million pesos, rather than estafa.
