Local business specially PUB relies on an ATM machine located outside the premises, which offers free withdrawals. However, if the machine does not maintain a certain level of transaction volume, the service provider might withdraw the machine or impose fees.
Legal Considerations:
1. *Consumer Protection Laws*:
- Under UK law, particularly the *Consumer Rights Act 2015*, it is permissible to set a minimum card transaction amount, provided this policy is communicated clearly to customers before they make a purchase. Transparency is key; customers must be fully aware of this minimum charge before completing a transaction.
2-Contractual Agreement:
When a minimum transaction amount is clearly communicated to customers before the transaction, it becomes part of the contractual agreement.
3. *Payment Services Regulations 2017*:
- The regulations allow merchants to set a minimum transaction amount for card payments. However, failure to clearly inform customers of this policy could result in under the grounds of unfair trading practices.
4. *ATM Utilisation*:
- The primary reason for setting this minimum transaction is to ensure that the ATM outside your shop remains operational by maintaining a sufficient number of transactions. If the ATM does not meet the required usage levels, the service provider may remove it or impose fees, which would negatively impact all business and customer convenience.which would inconvenience both the business and its customers.
- The minimum transaction amount of £3 is necessary to cover the costs of card processing and to maintain the free ATM machine outside the shop.
-By setting this minimum amount, the business can continue offering convenient services, such as access to cash withdrawals, which benefits everyone.
Conclusion:
Setting a minimum card payment transaction of £3 is legally permissible as long as it is clearly communicated to customers. This policy only for ensures the continued availability of the ATM machine for village, which is a valuable service for our village and local business
( But I feel some people or businesses have personal issues or moaning habit of criticising everything without knowing facts and then some other people also jump in this conversation.
Without knowing protocols and rules regulations, start to give legal points after googling. Everything not available on google.
Because of this behaviour, village has no post office, bank and now the bank van has also stopped coming. These type of people will make the ATM machine removed as well.
Here I am trying to different services to make things easy for village community. Paypoint, payzone and different courier services, we earn small commission in pennies with these time consuming services. and on the same time, we pay them monthly fees around £150 as well. All this is not even worth to us.
we are doing serious business and also try to support nearby local businesses.
I also request page admin not to please allow these kind of posts which damage any business goodwill without knowing facts and remove the post immediately.)
